terms

effective 2026-09-18 · the boxes are the friendly summary; the text under them is the agreement. read the whole thing. it's still short.

1 · who's who

deepkut = the hosted platform. the agent = software on your machine, under its own licence. these terms cover the platform only.

These terms are an agreement between you and Doll House Agency, Inc., a Delaware corporation ("deepkut", "we"), the operator of the hosted platform at my.deepkut.app and deepkut.app: accounts, agent pairing, the remote interface, and the waitlist (the "platform"). The agent is separate software, licensed to you under the deepkut box licence (section 3), that you install and run on hardware you control. By creating an account, joining the waitlist, or using the platform, you accept these terms. If you don't accept them, don't use the platform: the agent doesn't need us to work.

2 · eligibility & your account

You must be at least 13 years old to use the platform. You agree to give us an accurate email address, keep your password secret, and accept that whoever holds your credentials holds the account: activity under your account is yours. Tell us at abuse@deepkut.app if you think your account has been compromised. The free tier is two agents per account.

3 · the agent is licensed software

the agent is software you run yourself under its own licence. that licence, not these terms, governs it.

The agent is licensed to you under the deepkut box licence that ships with it. It is not part of the platform and is not a service we provide: it runs on your hardware and keeps running without any account here. Nothing in these terms limits, conditions, or adds to your rights under that licence, and the agent carries the warranty terms of that licence (no warranty). What you get from the platform is convenience around that software: accounts, pairing, a hosted interface. And only that convenience is governed by these terms. Versions of the agent we published earlier under the GNU Affero General Public License v3.0 stay under that licence.

4 · what the platform is (and very much isn't)

we run the control panel. your media lives on your hardware and streams from your box to your browser. it never touches our servers.

The platform provides account management, agent pairing, and a web interface to software running on your own hardware. The platform does not host, store, cache, transmit, index, or distribute any media content, and has no capability to do so: when you play media, the data moves directly between your device and your agent. We hold only the account and agent bookkeeping described in the privacy policy. The agent is separate software under its own licence. What it does on your equipment, including any third-party service it reaches, is between you and that service and is governed by that licence, not these terms. It ships no media content. All of it runs on your equipment, not ours.

5 · your responsibility

the agent is a tool on your hardware. you're responsible for the media you keep on it.

The agent is built for the management and archival of media you have a right to hold. You are solely responsible for how you use it and the platform, for the media you hold, and for complying with copyright and all other law in your jurisdiction. You represent that your use of the platform and the agent will be lawful. We do not monitor, and cannot see, your library. We have no relationship with, and no control over, any third-party service your agent reaches, and we endorse none of them.

6 · acceptable use

The acceptable use policy is part of these terms. In short: don't abuse the platform, don't touch other people's accounts, and keep only media you have the right to hold.

7 · copyright & dmca

we respect IP rights and expect you to. since no content lives on our servers, there's rarely anything here to take down, but there's a real process, and repeat infringement costs you your account.

We respect intellectual property rights and require the same of our users. Because the platform stores no media content, notices will usually concern a user's conduct rather than material hosted here. We act on them all the same.

notices. If you believe copyright infringement is occurring on or through the platform, send a notice under 17 U.S.C. § 512(c)(3) to our designated agent: dmca@deepkut.app (designated agent for Doll House Agency, Inc., registered with the U.S. Copyright Office, registration number DMCA-1079527). Include: identification of the copyrighted work; identification of the allegedly infringing material or activity and where it is; your contact information; a statement of good-faith belief that the use is unauthorized; a statement, under penalty of perjury, that the notice is accurate and you are authorized to act for the owner; and your physical or electronic signature. We review every notice and respond promptly.

counter-notices. If material you are responsible for is disabled and you believe that was a mistake or misidentification, you may send a counter-notice under 17 U.S.C. § 512(g)(3) to the same address, including: identification of the material and its former location; a statement under penalty of perjury of good-faith belief in the mistake; your name, address, and phone number; consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., any judicial district in which we may be found) and to accepting service from the notifying party; and your signature.

repeat infringers. We have adopted, and reasonably implement, a policy of terminating, in appropriate circumstances, the platform accounts of users who are repeat infringers, as evidenced by repeated valid infringement notices or by a court or other competent finding. Being honest about what termination means here: we can and will cut off the hosted services (your account, pairing, and the remote interface). We cannot reach software on your hardware, and we don't pretend otherwise. We also accommodate and do not interfere with standard technical measures within the meaning of 17 U.S.C. § 512(i). Knowingly materially misrepresenting infringement in a notice or counter-notice carries liability under 17 U.S.C. § 512(f).

8 · plans, billing & refunds

the beta is free, and invited testers get the library too. the librarian on your hardware stays free. a subscription, when plus goes on sale, buys the library and is sold through a merchant of record. they're the seller. you can cancel any time from your account, and you get a full refund within 30 days of your first payment, no questions asked.

The beta is free. The librarian running on your own hardware stays free. When plus goes on sale, a subscription buys the library: browse, search and play your shelf through the hosted interface. It also buys auto-organize, which does the rest on its own, with no tap: tags, cover art, names and folders for what arrives. The librarian on your own hardware finds and clears duplicates, free. We charge only for the library, never for what runs on your machine.

When paid plans launch, purchases will be processed by our merchant of record (currently planned: Lemon Squeezy). The merchant of record is the seller of your transaction: it charges your payment method, collects and remits applicable taxes, and its buyer terms govern checkout, billing, renewals, and refund processing; its name (not ours) may appear on your card statement. Prices and the renewal cadence will be stated plainly on the pricing page before you ever enter a payment detail. You get a full refund within 30 days of your first payment, no questions asked. You can cancel any time from your account, through the merchant of record's customer portal, effective at the end of the paid period; the merchant of record may additionally issue refunds at its discretion to resolve disputes.

founders lifetime. When founders lifetime is on sale, a purchase grants the library, the hosted shelf, for the operating lifetime of the deepkut platform, for as long as we offer it, on one account, non-transferable. "Lifetime" means the service's lifetime, not a guarantee of perpetual operation: if deepkut winds down entirely, the entitlement ends with it. By design, that event never touches your library or your agent: both are yours, on your hardware, and keep working without us.

9 · termination

You can delete your account any time from settings: it's immediate, and the privacy policy describes exactly what gets erased. We may suspend or terminate accounts that violate these terms (including the repeat-infringer policy), where required by law, or to protect the platform or its users; where practical we'll tell you why. On any termination your library is untouched, nothing of it was ever here, and the agent keeps working. Sections 3, 5, and 10 through 13 survive termination.

10 · disclaimers

the platform is provided as-is. it may break, change, or go away, and by design, your library doesn't go with it.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR MAKE ANY COMMITMENT REGARDING UPTIME. WE MAKE NO WARRANTY REGARDING ANY THIRD-PARTY SERVICE THE AGENT CAN REACH, AND NONE REGARDING THE AGENT, WHICH IS PROVIDED UNDER ITS OWN LICENCE AND ITS NO-WARRANTY TERMS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU. If the platform is down, your agent and your library keep working on your own network: that separation is the design, not an apology.

11 · limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THE PLATFORM OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY; AND (b) OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS (US$50) OR THE AMOUNTS YOU PAID FOR THE PLATFORM IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT THE LAW ALLOWS.

12 · indemnification

You will defend, indemnify, and hold harmless deepkut and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your use of the platform or the agent, including the media you hold or share; (b) your violation of these terms; or (c) your violation of any law or of any third party's rights, including intellectual property rights.

13 · governing law & disputes

talk to us first. a real human reads legal@ and most things fix in one email. formal disputes: california law, california courts, small claims stays open to you.

These terms are governed by the laws of the State of California, excluding its conflict-of-laws rules. Before filing any claim, you agree to first email legal@deepkut.app with a description of the dispute and give us thirty (30) days to resolve it informally. Any claim not resolved informally must be brought in the state or federal courts located in Los Angeles County, California, and both parties consent to their jurisdiction, except that either party may bring an individual claim in small-claims court where it qualifies, and either party may seek injunctive relief for infringement or misuse of intellectual property or of the platform in any court of competent jurisdiction.

14 · changes to these terms

We may update these terms. We'll update this page and its effective date, and for material changes we'll email account holders at least fourteen (14) days before they take effect. Continuing to use the platform after a change takes effect means you accept it; if you don't, delete your account: your library comes with you, because it never left.

15 · the boring but necessary bits

  • entire agreement. These terms and the privacy policy are the whole agreement between you and us about the platform, and supersede prior discussions. The agent is separately and exclusively governed by its own licence.
  • severability. If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the rest remains in force.
  • no waiver. Not enforcing a provision is not a waiver of it.
  • assignment. You may not assign these terms. We may assign them to a successor of the platform's business (for example, a corporate reorganization into a dedicated entity): your rights under them are unchanged by any such assignment.
  • summaries. The shaded boxes are good-faith plain-language summaries for readability; the full text of each section controls.
